I. General information.

  1. The Operator of the Website and the Administrator of the personal data is Oriontec Spółka z ograniczoną odpowiedzialnością Spółka komandytowa, with its seat in Mazańcowice at No. 57, 43-391 Mazańcowice, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Bielsko-Biała, 8th Commercial Division under KRS: 0000578111, NIP 9372676477, REGON 362608215, BDO 000049098 (hereinafter referred to as “Oriontec“).
  2. Oriontec allows contact via email: oriontec@oriontec.pl or ochronadanych@oriontec.pl, by telephone: +48 33 814 60 22 , by post to the address indicated in paragraph 1 above.
  3. The service performs functions to obtain information about users and their behaviour in the following ways:
    1. By voluntarily entering information in the forms,
    2. By storing cookies (so-called “cookies”) on terminal equipment
  4. Oriontec complies with the principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter “RODO“), adequately secures users’ personal data against unlawful access to personal data by third parties, in particular encrypts personal data, archives personal data, evaluates personal data security measures, ensures the confidentiality, integrity, availability and resilience of processing systems and services.

 II. Purpose and legal basis of data processing

  1. The service collects information voluntarily provided by the user.
  2. cIn addition, the service can save information about the connection parameters (time stamp, IP address).
  3. The personal data provided in the form is processed for the purpose resulting from the function of the specific form. In particular, the e-mail address for the purpose of subscribing to the newsletter and the name, surname, company name, e-mail and telephone number for contact purposes.
  4. The provision of data is voluntary, however, necessary in order to answer the question contained in the contact form and, in the case of subscribing to the newsletter, in order for it to be sent.
  5. By means of the newsletter, we only send you news from our offer, the provision of your e-mail address is done in order to receive commercial information from Oriontec.
  6. Oriontec processes your personal data in order to answer your question on the contact form, to establish, assert or defend against claims, for analytical, archival and accounting purposes, as well as to offer Oriontec products and services to you directly (direct marketing). Data for these purposes will be processed on the basis of Article 6(1)(b), (c) and (f) of the RODOa therefore when: processing is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering into a contract; processing is necessary for compliance with a legal obligation incumbent on the controller; processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
  7. Insofar as consent has been given for commercial information to be sent electronically in accordance with the Act of 18 July 2002 (Journal of Laws 2017.1219, i.e. as of 2017.06.24), the user will receive a newsletter and other materials to promote Oriontec products and services (direct marketing) at his/her e-mail address. Consent to the sending of commercial information by electronic means may be revoked at any time.
  8. No automated decisions (decisions without human involvement) will be made in relation to users, including my data will not be subject to profiling.
  9. This Service is not designed for or aimed at children under the age of sixteen.

III. Recipients of the Data

  1. Subject to all guarantees to ensure the security of the data transmitted, the following data recipients may have access to your personal data:
    1. Oriontec employees/co-workers authorised to process them on Oriontec’s instructions;
    2. service providers supplying Oriontec with technical and organisational solutions (in particular ICT service providers, marketing service providers, courier companies, legal and consultancy service providers and their authorised employees),
    3. entities performing data analytics for the purpose of personalising advertisements and which are separate controllers in this respect, in particular Google Ireland Limited.
  2. Your personal data may be transferred to countries outside the European Economic Area such as: The Rocket Science Group LLC d/b/a MailChimp (Priacy policy) subject to certification under the EU – US Privacy Shield, which can be checked at any time at the following address: https://www.privacyshield.gov/list /.
  3. Apart from the cases indicated in paragraph 2 above, Oriontec will not transfer or authorise the transfer of personal data provided by you outside the EEA (i.e. outside the European Union, Norway, Liechtenstein, Iceland) unless it takes the necessary measures to ensure that the transfer is in compliance with the RODO. The measures in question may include, in particular, the transfer of personal data to a recipient in a country that, in accordance with a decision of the European Commission, ensures adequate protection of personal data or to a recipient in the United States that has certified compliance with the EU-US Privacy Shield programme.

IV. Data retention period

Your personal data will be processed for no longer than is necessary
to respond to or send the newsletter, and after responding to or unsubscribing from the newsletter until the expiry of the limitation period for any claims by or against Oriontec. Personal data processed for the purposes covered by the statement of consent will be processed for these purposes until the consent is revoked.

V. Rights in relation to the processing of personal data

The user has the right to:

  • access to their data and receive a copy of their data;
  • rectification (amendment) of your data;
  • erasure – if, in your opinion, there are no grounds for us to process your data;
  • limitation of processing – if, in your opinion, we have inaccurate data about you or are processing it unfoundedly; or you do not want us to delete it because you need it to establish, assert or defend a claim; or for the duration of your objection to the processing;
  • object to the processing of your data for direct marketing purposes and the right to object to the processing of your data on the basis of legitimate interest for purposes other than direct marketing;
  • data portability – you have the right to receive from Oriontec
    in a structured, commonly used, machine-readable format your personal data that you have provided to Oriontec on the basis of a contract or consent, or you may have Oriontec send this data directly to another party;
  • to lodge a complaint with a supervisory authority – if the user considers,
    that we are processing your data unlawfully, you may lodge a complaint to this effect with the President of the Data Protection Authority or any other competent supervisory authority;
  • The right to withdraw consent to the processing of personal data – at any time you have the right to withdraw your consent to the processing of those personal data that Oriontec processes on the basis of your consent; withdrawal of consent will not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.

 VI. Information about cookies.

  1. The website uses cookies.
  2. Cookies (so-called “cookies”) are IT data, in particular text files, which are stored in the Service user’s terminal equipment and are intended for the use of the Service’s websites. Cookies usually contain the name of the website they come from, the time they are stored on your terminal equipment and a unique number.
  3. The operator of the Website is the entity placing cookies on the Website user’s terminal equipment and accessing them.
  4. Cookies are used for the following purposes:
    1. producing statistics which help us to understand how visitors to the Website use the websites, so that we can improve their structure and content;
    2. maintenance of the Service user session;
    3. to define your profile in order to display tailored material to you on advertising networks, in particular the Google network.

  10. Oriontec uses Google Analytics, a web audience analysis service provided by Google. Google Analytics uses cookies. The data collected via cookies by Google Analytics (including your IP address) are used to evaluate your use of the Oriontec website, to compile reports on website traffic for website operators and to provide other services relating to website traffic and internet usage.
  11. Oriontec uses Google AdWords, a service provided by Google that helps us to better target our advertising and promotions.

    1. Information about certain user behaviour is subject to logging at the server layer. This data is used exclusively for the administration of the website and to ensure that the hosting services provided are as efficient as possible.
    2. The resources viewed are identified by URLs. In addition, the record may be subject to:
      1. the timing of the enquiry,
      2. response time
      3. the name of the user station – identification via the HTTP protocol,
      4. information about errors that occurred during the execution of the HTTP transaction,
      5. the URL of a page previously visited by the user (referer link), in the event of a link to the Website,
      6. information about the user’s browser,
      7. IP address information.
